1. 我们提供的服务 —— 加州持照公证员提供公证服务（签名认证、宣誓陈述、委托书副本认证、宣誓），以及 Apostille 文件递交代办与格式预审。

2. 我们不提供的服务 —— 我方不是政府机构、不是律师事务所、不是移民顾问。按加州法律，公证员不得：提供法律意见；建议您该用哪一种公证；解释文件的法律含义或后果；代填文件；代填移民表格；判断某份文件是否满足接收方（外国政府、学校、法院、雇主）的要求；保证翻译准确性。文件是否满足您的使用目的，须由您本人或您的律师确认。

3. 公证必须满足的法定条件 —— 签字人必须本人到场（加州不允许代签、拍照代签或视频公证）；必须出示未过期且加州认可的证件 （中国护照可用，中国身份证不可用）；签字人必须清醒、自愿、明白自己在签什么。不满足以上任一条，我们必须拒绝办理。

4. 上门服务的特别约定 —— 上门费是出行成本，与公证费分开计算，收据会分项列明。上门费不因公证未能完成而退还，包括但不限于：签字人不在场、证件过期或不被加州认可、签字人意识不清或明显被强迫、文件未填好、地址有误或无法进入、超出约定等候时间后离开。房产与贷款类文件 （Deed / Grant Deed / Deed of Trust / Quitclaim / 贷款签署包）适用产权文件收费，须提前预约。

4A. 关于房地产经纪人身份 —— 我方部分公证服务由同时持有加州房地产经纪人执照的公证员提供。按加州 Government Code §8224，公证员不得对自己有直接财产或经济利益的交易办理任何公证。因此：若该公证员本人是该笔交易的卖方、买方、产权人、受益人，或是该笔交易的代理经纪人并从中收取佣金，我们必须拒绝为该笔交易公证，并会为您另行安排独立公证员。为您代理买卖房屋与为您的文件公证，是两项相互独立的服务，我们不会把两者捆绑。

5. 我们不承担责任的情形 —— 以下情形我方不承担责任，已发生的州费不予退还：
  • 文件本身有缺陷、错误、缺页、签名不全、公证瑕疵，导致被州务卿拒收
  • 文件认证后，接收方（外国政府、学校、法院等）仍不接受
  • 州务卿柜台关闭、排队延误、系统故障、政策变更
  • 邮政或快递在寄送途中的延误、丢失、损坏
  • 您提供的信息（地址、时间、文件状态）不准确、不完整或有误导
  • 因办理时间导致您错过任何截止期限（签证面试、入职、开学、法院期限等）
  • 任何间接、附带、后果性损失，包括利润损失、机会损失、精神损害
出件时效与到达时间均为尽力而为，我方不作保证。

6. 赔偿上限 —— 我方对单笔委托的赔偿总额以您已支付的服务费金额为上限，不含州政府官费及第三方费用。

7. 关于文件照片 —— 照片仅用于格式预审，7 天内删除，不长期留存，不出售不外传。请勿发送完整高清全文件；请勿在照片中包含完整社会安全号、银行账号、信用卡号。Apostille 原件请勿邮寄，须本人当面交付并签署交接单。

8. 预审结论的性质 —— 预审结论仅表示文件在格式上看起来可以递交，不构成对办理成功、时效或接收方接受度的任何保证或承诺。

9. 报价 —— 我们在收件或出发前一次性报出总价。若需预处理，先报价、经您同意后才开始，绝不擅自追加费用、绝不到场加价。

10. 文本编辑 / 录入服务 —— 我方可按您提供的文字进行录入、排版、打印，收费 $35（超过 5 页加 $10）。就此项服务，您理解并同意：
(a) 内容由您提供。 我方只照您给出的文字录入与排版，不替您决定文件怎么写、不添加或删改任何条款、不建议用词。按加州 Business & Professions Code §6125，非律师不得起草法律文件或提供法律意见；如您需要起草文件或法律意见，请咨询律师。
(b) 接收方是否接受由您自行确认。 编辑完成的文本不代表接收方（学校、法院、外国政府或机构、雇主、中国相关部门等）一定接受。请您事先向接收方确认格式与内容要求，或请接收方直接出具文本供我方照打。因文本内容不被接收方接受而产生的任何后果，我方不承担责任。
(c) 一经开始，费用不退。 本项服务属人工作业，开始作业后无论结果如何均不予退费。
(d) 重做按新单计费。 若编辑完成后您需按新的或修改后的内容重新制作，视为新的一笔服务另行计费，不包含在原 $35 之内。
Text typing/formatting ($35, +$10 over 5 pages): we type and format only the text you supply. We do not draft documents, add or alter terms, or advise on wording (CA B&P §6125 — non-attorneys may not draft legal documents or give legal advice). You are solely responsible for confirming with the receiving party that the text is acceptable, or for having the receiving party supply the text. Fees are non-refundable once work begins. Redoing the work with new or revised content is billed as a new order.

WEMAIL Notary & Apostille provides notarial services by a commissioned California Notary Public and Apostille filing/pre-review. We are not a government agency, not a law firm, and not an immigration consultant. Under California law a notary may not give legal advice, advise which notarial act to use, explain documents, or complete forms for you. Signers must appear in person with valid ID (Chinese passport accepted; Chinese national ID not accepted). Travel fees are separate from notarial fees and are non-refundable if the notarization cannot be completed. Do you provide a Chinese or Mandarin notary in San Jose and Fremont?

Yes. WEMAIL provides bilingual Mandarin-English mobile notary service in San Jose, Fremont and surrounding South Bay and East Bay cities. 我们可用普通话说明 办理流程和所需证件，但根据加州法律不能提供法律意见或选择公证类型。

How much does a mobile notary cost in the Bay Area?

California notarial acts are $15 per notarized signature. The mobile travel fee starts at $95 for locations within 10 miles of our Fremont or San Jose dispatch point; longer routes are quoted by distance. You receive the full quote before confirming the appointment.

Can you apostille California documents for use in China?

Yes. We assist with California Secretary of State apostille filing for eligible California documents, including notarized powers of attorney and certified vital records. Since November 7, 2023, eligible U.S. public documents for mainland China generally use an Apostille instead of consular legalization. The receiving organization should confirm its exact requirements.

Do you travel to hospitals, care facilities and offices?

Yes. Mobile appointments are available at homes, offices, hospitals, assisted-living facilities and other agreed locations. The signer must be willing and aware, communicate directly with the notary, and present identification accepted under California law.

What should I prepare before the notary arrives?

Have the complete unsigned document, acceptable current identification, all signers and any required witnesses ready. Do not sign before the appointment unless the notary instructs you to do so. Ask the receiving agency or your attorney which notarial act is required.
